Terms & Conditions

General

The Company namely John Craddock Ltd, 76 North Street, Bridgtown, Cannock WS11 0AZ. T: 01543 577207. Suppliers of parts & accessories for Land Rover vehicles.

These are the Company terms & conditions of sale to which all sales including E-Commerce and distance selling is subject. It is the customer responsibility to read the T&C’s on each occasion a purchase is required. 

Title & Risk.

Risk of any products shall pass to the buyer or their appointed agent upon receipt of delivery. The title of the goods shall pass to the buyer upon cleared payment in full of the invoice price including delivery costs, until such time the title and ownership of the goods remain with the company. The Company shall be entitled at any time to recover any or all products in the buyers possession to which the Company have title, and for that purpose the Company it’s employees or agents may with such transport as is necessary enter upon any premises occupied by the buyer or any third party or to which the buyer has access and where the goods may be or are believed to be situated. 

Prices - All prices are in GBP Sterling and subject to VAT at the current rate of 20% on all items except books in the UK & other EU Community Countries.  For E-commerce ordering there is a currency changer in the shopping cart. The Company shall not liable for any delay or failure to deliver goods or otherwise perform any obligation as specified in these T&C’s if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control. Prices listed or quoted are based upon costs prevailing at the time when posted on the website or communicated verbally as agreed. The company shall be entitled to adjust the price of the goods as at the time of despatch and or provision by such amount as may be necessary to cover any increase sustained by the company after the date of acceptance of the buyers order and any direct or indirect costs of making, obtaining, handling storing or supplying the goods. Any such adjustment shall be given will be given in writing by the company to the buyer prior to despatch of the goods. Any quotations are valid for 30 days and subject to conditions.

E-Commerce - VAT will automatically be calculated before you submit your order when you go to the checkout page on our secure server.  The Company will confirm receipt of your order using the address you supplied when registering on our website. This email is only an acknowledgement and does not constitute legal acceptance by us of your order. Telephone or in person - VAT will be given to you verbally and added onto your final invoice along with any agreed carriage costs. Payment - All goods must be paid for in full in GBP £ Sterling before them or any vehicles or other objects upon which services have been performed are released to the buyer.

Delivery of Goods

E-Commerce - Various delivery options including costs is on our website and can be product specific. If unsure please speak to an advisor. Telephone or in person - Various delivery options including costs will be offered. Unless otherwise stated all carriage costs to be paid by the customer. Free delivery is offered on UK mainland orders over £50.00 (exc VAT) for the first standard delivery size box. For any additonal boxes, oversize or overweight items delivery surcharges may apply. These surcharges may be added at the point of sale upon checkout, or we may need to contact you after your order has been placed to request payment. Any shortages, or non-delivery or damage of goods ordered, the buyer needs to inform the Company within 3 working days. Our transit times are quoted in working days and are subject to change depending upon the size, content of the shipment as well as the origin and destination locations within each country. Please note deliveries to remote areas may take longer. Any special instructions for deliveries to be left in safe places or with neighbours are at the liability of the customer.

Duties and Taxes

All sales orders dispatched to overseas and international destinations will be subject to customs clearance, duties and taxes. These charges will be calculated by the shipping agent and they shall contact the recipient (customer) to arrange payment. The payment and onus of any duties and taxes is the responsibility of the recipient. The charges are specific to the recipient country, these are calculated on value, quantity, weight and shipping value.

If the duties and taxes payment is not received from the recipient to the shipping agent, the recipient will be responsible for any charges of the delivery being returned to the consignor (John Craddock Ltd) and will be charged such amount by John Craddock Ltd. If the recipient requires redelivery of the sales order they will be responsible for an additional delivery payment.

Warranty - General

Parts warranty & Liability - All new products are covered by a 12 month manufactures warranty unless otherwise stated. You must notify us immediately if a potential warranty situation arises. We will then advise a course of action. Any suspected faulty product must be returned to us together with the original invoice or proof of purchase and with as much information relating to the problem as possible. Any defective parts must be returned and received by us before it can be exchanged. All warranty items are subject to a physical inspection which may involve returning the item to our supplier to verify the fault before it can be exchanged or refunded. The warranty commences from the original invoice date and not the date of fitment or first use. The warranty covers defects to the item when fitted and used correctly for normal everyday use but does not apply to items used for any extraordinary or unusual uses such as competition, racing, rallying or items subsequently stripped down, altered, modified or adapted etc. in any way than their original design or intend use. Although we are by law liable for death or personal injury caused by our proven negligence and by The Sale Of Goods act 1979, our warranty only covers the product in question and not for any consequential loss or cost, e.g. garage labour, recovery, car hire, re-delivery, parking fines etc.  No claim will be validated if the failure is caused by misuse neglect, overheating, incorrect installation or failure of a related component. Upon acceptance of any warranty item it will be either repaired or replaced free of charge and will only benefit from the balance of the original warranty. Subject to a replacement not being available a full refund will be given.

Legal

These conditions and the contract shall be governed by and construed and interpreted in accordance with English law and for the purpose of settlement of any disputes arising out of in connection with them the parties will submit themselves to the jurisdiction of the English courts.

The statutory regulations for implementation of the convention concluded at The Hague on 1st July 1974 relating to a uniform law on the International sale of goods shall not be applicable to this contract. 

Acceptance of good(s) shall signify your acceptance and to be bound by the Company’s latest Terms and Conditions.
