Terms of Business John Craddock LTD

General

The conditions prevail over any conditions which the purchaser's order may purport to impose and which are at variance with the same. No modification of these conditions shall be binding upon the Company unless specifically accepted in writing by the Company. We cannot accept any claims for accross in this web database which may have been made inadverently. We reserve the right to make technical changes. These conditions constitute the entire agreement between parties and supersedes any previous agreement and pricelist issued. No other party shall acquire any rights under this agreement in spite of the Contracts (Right of third parties) Act 1999.

Price

The company reserves the right to vary the quoted price, and goods will be invoiced to the purchaser at the price ruling at the date of dispatch unless otherwise agreed by the company in writing. All prices quoted are exclusive of Value Added Tax of 20% if applicable.

Price Pledge

We guarantee to beat any other price on like for like items. Items must be available and of the same origin. John Craddock Ltd will not stock inferior imported motor spares.

VAT

All prices listed on the shopping cart are exclusive of Vat.

Payment

Unless otherwise agreed, payment must be made at the end of the month following the month of invoice. Without prejudice to any oter company reserve the right to charge interest on overdue accounts at the rate 4% per annum above base rate.

Delivery Overseas

Despatch of overseas orders will commence upon reciept of:
(i) A bank draft, or
(ii) An irrevocable confirmed letter of Credit drawn at sight on UK Joint Stock Bank, or
(iii) As otherwise agreed with the Company.

Delivery Dates

Whilst the company will do its utmost to keep its promised delivery dates, they are to be treated as estimates only. The company accepts no responsibility for loss or damage resulting from delay in delivery of goods. Delays due to circumstances outside the control of the company shall not entitle the purchaser to cancel an order or to refuse to accept delivery.

Damage or Loss In Transit

Claims for damage or loss in transit must be sent to the company in writting within 7 days of delivery.

Guarantee

The company will replace or credit the purchaser with the value of any defective goods of its manufacture if the company is satisfy that such defects accross slowly through faulty material or workmanship, and such goods are returned carriage paid immediately upon discovery of the defect and, in any event, not later than 6 months from date of dispatch. The company shall in no circumstances be liable for any consequently loss or damage.

Return Goods

The postage on goods returned will not be refunded if the customer is at fault in ordering the goods and a further restocking charge of 15% will be levied on goods returned that are "non stock items".   Please complete and enclose the returns form which can be found on the links section of this website with your return parcel. If your return does not include the form your refund or exchange will be delayed whilst we obtain all the necessary information to process the return. Items returned as faulty are returned to our suppliers for testing, the results of these tests may take up to 4 weeks. Please send your item for return and the returns form to:

Descriptions

Every effort is made by the Company to ensure that its products are accurately described and are fit for the purposes and applications atated in the Company's web database but the Company gives no warranty to this effect and accepts no responsibility for any loss or damage arising from errors or incorrect descriptions within the web database. All descriptions of spare parts are intended as a guide only and do not necessarily Land Rover Company manufacture. Manufacture part numbers are used for identification only and do not imply or indicate the identify of the manufacture.

Acceptance of Order

Quotations do not constitute an offer by the Company to supply the goods, and no orders shall be binding unless accepted by the Company in writing.

Exclusion of Liability

These conditions are in substitution for and exclude all and any express and implied statutory or other warranties, guarantees, representations, conditions and liabilities.

Ownership

The goods shall remain the property of John Craddock Ltd. until payment is recieved for all account sales, and the Company shall have the right at the time prior to recieving payment in full, to enter on to the purchaser's premises to repossess the goods.

Manufacturer's Part Numbers

Manufacturer’s part numbers are quoted for reference purposes only.

Miscellaneous

These conditions shall be governed by and constued in accordance with English Law.
